Cashira Terms & Conditions

Acceptance of Terms

By accessing, browsing, or using any aspect of the Cashira service, including but not limited to our websites, mobile applications, desktop applications, application programming interfaces (APIs), or any other services provided by Consultants Lengu Inc. (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety.

These Terms constitute a legally binding agreement between you (either an individual or a single entity) and Consultants Lengu Inc. ("Cashira," "we," "us," or "our"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" or "your" will include that organization.

This summary provides a simplified overview of key terms, but the legally binding provisions are found in the detailed sections below. This summary does not replace or modify the actual Terms.

Key Points:

  • Read-Only Service: Cashira provides read-only access to your financial and calendar data. We cannot move money or initiate payments under any circumstances.
  • AI Guidance Only: Our AI-powered insights, forecasts, and suggestions are for informational purposes only and do not constitute financial, legal, tax, or investment advice.
  • Subscription Terms: Various subscription plans are available with different features. Subscriptions automatically renew unless canceled before the renewal date.
  • Your Data Rights: You retain ownership of your content, but grant us necessary licenses to provide the Service. Our data practices are governed by our separate Privacy Policy.
  • Consumer Protections: Your consumer rights vary by jurisdiction. See the jurisdiction-specific sections for details about cancellation rights, refunds, and other protections.
  • Dispute Resolution: Most disputes will be resolved through binding arbitration rather than court proceedings, with class action and jury trial waivers where permitted by law.
  • Service Limitations: The Service is provided "as is" without warranties, and our liability is limited as described in these Terms.

Definitions

"Service"
Refers to all Cashira websites, applications, APIs, software, documentation, and related services provided by Consultants Lengu Inc.
"Content"
Includes all information, data, text, software, sound, photographs, graphics, video, messages, or other materials submitted, posted, displayed, or transmitted through the Service.
"User Content"
Content that you submit, upload, post, display, or otherwise make available through the Service, including but not limited to financial data, calendar entries, notes, and preferences.
"Third-Party Services"
External services integrated with Cashira, including financial institutions, calendar providers, authentication services, and other platforms.

1. Eligibility & Account Registration

Age and Capacity Requirements

You must be at least the age of digital consent in your jurisdiction to create an account and use the Service. In most jurisdictions, this is between 13 and 16 years of age. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent and supervision of your parent or legal guardian, who must agree to these Terms on your behalf.

Children under the applicable minimum age may only use the Service with verifiable parental consent in accordance with applicable laws, including the Children's Online Privacy Protection Act (COPPA) in the United States and similar regulations in other jurisdictions. Parents or guardians who register accounts for minors assume full responsibility for the minor's use of the Service.

By using the Service, you represent and warrant that you have the legal capacity to form a binding contract with Cashira, and are not barred from receiving services under the laws of your jurisdiction or other applicable jurisdictions.

Account Registration and Security

To access certain features of the Service, you must register for an account. During registration, you must provide accurate, current, and complete information as prompted by the registration process. You agree to maintain and promptly update your account information to keep it accurate, current, and complete.

Credential Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong, unique password for your Cashira account
  • Enable multi-factor authentication where available
  • Immediately notify us of any unauthorized use of your account or any other security breach
  • Ensure that you properly log out from your account at the end of each session
  • Not share your account credentials with any third party

Cashira will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Account Types and Roles

Depending on your subscription plan, different account types and roles may be available:

  • Individual User: Standard account for personal use
  • Team Admin: Administrative access for organizational accounts with user management capabilities
  • Billing Owner: Responsibility for payment and subscription management
  • Enterprise Administrator: Full administrative control over enterprise accounts and API access

Geographic Availability and Restrictions

The Service is currently available in over 45 countries worldwide. However, access to certain features, integrations, or subscription plans may be limited based on your geographic location due to legal, regulatory, or technical constraints.

You are solely responsible for determining whether your use of the Service complies with applicable local laws and regulations. Some jurisdictions may restrict or prohibit the use of financial aggregation services, AI-powered tools, or cross-border data transfers. It is your responsibility to ensure that your use of the Service is lawful in your jurisdiction.

Cashira reserves the right to limit the availability of the Service or any portion thereof to any person, geographic area, or jurisdiction at any time at our sole discretion.

Account Verification

We reserve the right to verify your identity and account information through various means, which may include requesting additional documentation, using third-party verification services, or other methods we deem appropriate. Failure to provide requested verification information may result in suspension or termination of your account.

For certain subscription levels or in specific jurisdictions, enhanced verification procedures may be required to comply with anti-money laundering regulations, financial services laws, or other legal requirements.

2. Subscriptions, Trials, Fees & Taxes

Subscription Plans and Features

Cashira offers multiple subscription tiers with varying features and capabilities. The specific features available to you depend on your selected subscription plan. We reserve the right to modify, add, or remove features from any subscription tier at any time, with notice provided as described in Section 19.

Basic Plan

Our entry-level subscription offering limited features and capabilities, designed for individual users with basic budgeting needs.

Pro Plan

Enhanced features for individual users and small teams, including advanced analytics, priority support, and additional integrations.

Enterprise Plan

Comprehensive feature set for organizations, including API access, advanced security features, dedicated support, and administrative controls.

Billing and Auto-Renewal

Unless otherwise specified in your subscription agreement, all paid subscriptions automatically renew at the end of each billing cycle for successive periods of the same length. The billing cycle depends on your selected subscription term (monthly, annually, etc.).

Renewal Notice

We will provide you with advance notice of any price changes or subscription renewals. The notice period will comply with applicable legal requirements in your jurisdiction, typically ranging from 30 to 60 days before the renewal date.

Cancellation of Auto-Renewal

You may cancel auto-renewal at any time before the renewal date through your account settings or by contacting support. If you cancel auto-renewal, your subscription will remain active until the end of your current billing period, after which it will not renew.

Pro-ration and Changes

If you upgrade your subscription, the new rate will be prorated for the remainder of your current billing cycle. Downgrades typically take effect at the start of your next billing cycle. No refunds or credits are provided for partial months of service, downgrades, or unused time, except where required by law.

Free Trials and Promotional Offers

Cashira may offer free trials or promotional subscriptions at our discretion. Specific terms and conditions will accompany any trial or promotional offer.

Trial Conversion

At the end of a free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. We will send reminder notices before the trial period expires, but you are responsible for tracking the trial end date and canceling if desired.

Introductory Pricing

Special introductory pricing may be available for new subscribers. After the introductory period, your subscription will renew at the standard rate for your selected plan.

Trial Eligibility

We reserve the right to limit free trial eligibility, including restricting users from participating in multiple trials. Abuse of trial offers may result in account suspension or termination.

Payment Methods and Processing

Payments for subscriptions can be made through various methods, including credit/debit cards, app store payments (Apple App Store, Google Play Store), or enterprise invoicing for qualified business customers.

Payment Authorization

By providing a payment method, you authorize Cashira (or our third-party payment processors) to charge all subscription fees to that payment method. You must maintain valid, up-to-date payment information in your account.

Failed Payments

If a payment fails, we may attempt to retry the payment method. Continued payment failures may result in suspension or termination of your subscription. Reinstatement of suspended accounts may require payment of all outstanding amounts.

Enterprise Invoicing

Enterprise customers may be eligible for invoiced billing. Invoiced amounts are typically due within 30 days of invoice date. Late payments may be subject to interest charges at the maximum rate permitted by law or 1.5% per month, whichever is lower.

Taxes

All subscription fees are exclusive of any taxes, levies, duties, or similar governmental assessments, including value-added tax (VAT), goods and services tax (GST), harmonized sales tax (HST), provincial sales tax, and other similar charges (collectively, "Taxes").

You are responsible for paying all Taxes associated with your purchases, except for taxes based on our net income. Where required by law, we will collect and remit Taxes on your behalf. In all other cases, you are responsible for self-assessing and remitting applicable Taxes to the appropriate tax authorities.

For customers subject to Canadian HST/GST/QST, European VAT, or other similar transaction taxes, the applicable tax rate will be determined based on your location and the nature of the services provided.

Refund Policy

Generally, Cashira does not provide refunds for subscription fees, except where required by law. This includes partial refunds for unused subscription periods, downgrades, or cancellations mid-billing cycle.

Legal Exceptions

Notwithstanding our general no-refund policy, certain jurisdictions provide statutory refund rights that cannot be excluded. These include:

  • EU/EEA/UK: 14-day withdrawal right for distance contracts
  • Australia: Consumer guarantees under the Australian Consumer Law
  • Various US states: Specific refund rights under state consumer protection laws
  • Canada: Provincial consumer protection legislation

Chargebacks and Payment Disputes

If you dispute a charge with your payment provider (a "chargeback"), we may suspend your account during the investigation. Fraudulent chargebacks may result in permanent account termination and additional collection actions.

Price Changes

We reserve the right to change subscription prices at any time. Price changes for existing subscriptions will be communicated in accordance with Section 19 and will not take effect until the start of your next billing cycle following the notice period.

If you do not agree to a price change, you may cancel your subscription before the price change takes effect. Continued use of the Service after the price change effective date constitutes acceptance of the new pricing.

6. Financial + Calendar Integrations (Read-Only)

Read-Only Nature of Service

Cashira is a read-only financial aggregation service. We emphasize and reiterate that under no circumstances can Cashira move money, initiate payments, transfer funds, modify account balances, execute trades, or perform any other financial transactions. The Service is designed solely to retrieve, analyze, and display your financial information for budgeting and planning purposes.

You acknowledge and agree that Cashira acts as a passive conduit for your financial data and does not engage in any financial intermediation, payment processing, or funds transmission. We are not a financial institution, money services business, payment processor, or money transmitter under applicable laws.

Data Accuracy and Timeliness

Financial data provided through the Service is sourced from third-party financial institutions and data aggregators. This data may be delayed, incomplete, or inaccurate for various reasons, including but not limited to:

  • Technical issues at financial institutions or data aggregators
  • Scheduled maintenance or unscheduled downtime
  • Data synchronization delays
  • Incorrect categorization or classification
  • Pending transactions that have not cleared
  • Currency conversion approximations

Cashira does not guarantee the accuracy, completeness, timeliness, or reliability of any financial data displayed through the Service. You should always verify critical financial information directly with your financial institutions before making decisions based on information provided by Cashira.

We are not responsible for any losses, damages, or inconveniences resulting from reliance on inaccurate, delayed, or incomplete financial data provided through the Service.

Third-Party Financial Institution Integration

Cashira integrates with thousands of financial institutions worldwide through various methods, including:

API Integrations

Where available, we use official APIs provided by financial institutions or open banking platforms. These integrations typically provide the most reliable and secure data access.

Credential-Based Aggregation

For institutions without API access, we may use secure credential-based aggregation through authorized third-party data aggregators. In these cases, you provide your online banking credentials to the aggregator, who uses them to retrieve your financial data on your behalf.

Screen Scraping

In limited circumstances where no other method is available, data aggregators may use screen scraping techniques to retrieve your financial information. We prioritize API-based integrations wherever possible.

By using the Service, you authorize Cashira and our designated data aggregators to access your financial accounts on your behalf for the sole purpose of providing the Service. You represent that you have the legal right to provide such authorization for all accounts you connect to the Service.

Regional Open Banking Compliance

In jurisdictions with open banking regulations, Cashira operates in compliance with applicable frameworks:

European Union/EEA

We operate as an Account Information Service Provider (AISP) under PSD2 regulations, using authorized Third-Party Providers (TPPs) to access payment account information.

United Kingdom

We comply with UK Open Banking standards and work with FCA-authorized TPPs for account access.

Other Jurisdictions

We monitor and comply with emerging open banking regulations in Canada, Australia, Brazil, and other markets where we operate.

Calendar Integration

Cashira's calendar integration allows you to connect various calendar services (such as Google Calendar, Apple Calendar, Microsoft Outlook, etc.) to provide scheduling context for your financial planning.

Access Scope

When you connect a calendar service, we request access to read your calendar events, including event titles, descriptions, dates, times, and participants. We do not modify, delete, or create calendar events unless explicitly authorized by you for specific features.

Scheduling Suggestions

Any scheduling suggestions, conflict detection, or optimization recommendations provided by the Service are for informational purposes only. You remain solely responsible for managing your schedule and calendar entries.

Data Usage

Calendar data is used solely to provide context for your financial planning and to identify potential scheduling conflicts with financial activities. We do not use calendar data for advertising purposes or share it with third parties except as necessary to provide the Service.

Credential Security and Storage

Cashira takes credential security seriously. When you provide financial institution or calendar service credentials:

  • We never store your actual login credentials on our servers
  • Credentials are encrypted and stored by our authorized data aggregators
  • We use token-based authentication where supported by financial institutions
  • All data transmission is encrypted using industry-standard protocols

However, you should be aware that providing your credentials to any third party involves some risk. You should only connect accounts for which you are authorized to share access, and you should regularly monitor your financial accounts for unauthorized activity.

Service Outages and Limitations

Financial data aggregation involves multiple systems and services, any of which may experience outages or performance issues. Cashira is not responsible for:

  • Financial institution website outages or maintenance
  • Data aggregator service interruptions
  • Open banking API rate limiting or downtime
  • Connectivity issues between any of these systems

We make reasonable efforts to maintain service availability and provide status updates during widespread outages, but we cannot guarantee uninterrupted access to your financial data.

Account Disconnection

You may disconnect linked financial accounts or calendar services at any time through your account settings. Disconnecting an account will stop new data from being retrieved, but historical data may be retained in accordance with our data retention policies as described in our Privacy Policy.

Cashira reserves the right to disconnect accounts that repeatedly experience connection issues, violate financial institution terms of service, or pose security risks.

14. Consumer Rights & Jurisdiction-Specific Terms

General Consumer Rights

Cashira respects consumer rights worldwide and complies with applicable consumer protection laws in the jurisdictions where we operate. This section outlines key consumer rights and jurisdiction-specific terms that may apply to your use of the Service.

If any provision in these Terms conflicts with mandatory consumer protection laws in your jurisdiction, the consumer protection laws will prevail to the extent of the conflict.

EU/EEA Consumer Rights

If you are a consumer in the European Union or European Economic Area, you benefit from various mandatory consumer protection laws, including:

14-Day Withdrawal Right

Under the Consumer Rights Directive, you have the right to withdraw from this distance contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the contract conclusion.

However, if you explicitly consent to the service beginning during the withdrawal period and acknowledge that you will lose your withdrawal right, the 14-day withdrawal period does not apply once the service has been fully performed.

To exercise the withdrawal right, you must inform us of your decision to withdraw by sending a clear statement to legal@cashira.app. You may use the model withdrawal form provided in Appendix B, but it is not obligatory.

Digital Content Directive

Under the Digital Content and Digital Services Directive, you have rights regarding the conformity of digital content and services, including the right to have the service brought into conformity, price reduction, or contract termination in case of lack of conformity.

Unfair Contract Terms

The Unfair Contract Terms Directive protects you against unfair standard contract terms. If a court finds any term of these Terms to be unfair, that term will not be binding on you.

United Kingdom Consumer Rights

If you are a consumer in the United Kingdom, you benefit from rights under the Consumer Rights Act 2015 and other consumer protection legislation.

Service Conformity

The Service must be provided with reasonable care and skill, be fit for purpose, and match any description given by us. If the Service does not conform to these standards, you may be entitled to a price reduction or the right to receive a reperformance of the service.

Digital Content Rights

Under the Consumer Rights Act, digital content must be of satisfactory quality, fit for purpose, and as described. If digital content damages your device or other digital content, you may be entitled to compensation.

Various state laws provide additional consumer protections beyond federal requirements. Key state-specific provisions include:

California

Under California Civil Code Section 1789.3, California users are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

The California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide additional privacy rights, which are detailed in our Privacy Policy.

New York

New York General Business Law requires specific auto-renewal disclosures and cancellation mechanisms for subscription services.

Colorado

The Colorado Consumer Protection Act provides various consumer protections, and the Colorado Privacy Act provides additional privacy rights.

Other States

Various other states have specific consumer protection laws regarding auto-renewal subscriptions, cancellation rights, and privacy. See Appendix A for detailed state-specific disclosures.

Nothing in these Terms limits any non-waivable rights you may have under your state's consumer protection laws.

Cooling-Off Periods and Withdrawal Rights

Many jurisdictions provide cooling-off periods or withdrawal rights for distance contracts. The availability and duration of these rights vary by jurisdiction:

Standard Cooling-Off Periods

  • EU/EEA/UK: 14 days for most distance contracts
  • Australia: Varies by circumstance, typically 10-30 days for unsolicited consumer agreements
  • Canada: Varies by province, typically 10-30 days for certain distance contracts
  • Brazil: 7 days for distance contracts under the Consumer Protection Code
  • Various US States: Specific cooling-off rights for certain types of contracts

Exceptions for Digital Services

In many jurisdictions, the cooling-off period does not apply if you explicitly consent to the service beginning during the withdrawal period and acknowledge that you will lose your withdrawal right once the service has been fully performed.

By using the Service during any trial period or immediately after subscription, you may be deemed to have requested immediate performance and acknowledged the loss of your withdrawal right for the services already performed.

15. Warranty Disclaimers

No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, CASHIRA AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Service or the servers that make the Service available are free of viruses or other harmful components.

Accuracy Disclaimers

Cashira does not warrant or make any representations regarding the use or the results of the use of the Service in terms of their correctness, accuracy, reliability, or otherwise. We do not guarantee that:

  • Financial insights, categorizations, or forecasts will be accurate
  • Budgeting outcomes or financial goals will be achieved
  • AI-powered suggestions will be appropriate for your specific circumstances
  • Data from third-party services will be complete, timely, or accurate
  • The Service will meet your specific requirements or expectations

You understand and agree that any material or data downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material or data.

Jurisdictional Variations

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may have other rights that vary from jurisdiction to jurisdiction.

In particular, nothing in these Terms affects any statutory rights that you have as a consumer that cannot be contractually limited or excluded. Where any warranty cannot be excluded, our liability for such warranty is limited (at our option) to the resupply of the services or the payment of the cost of resupply.

Third-Party Content and Services

We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Service or any hyperlinked website or service, and we will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.

16. Limitation of Liability

General Limitation

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASHIRA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF CASHIRA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF CASHIRA AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS FOR ALL CLAIMS RELATING TO THE SERVICE SHALL BE LIMITED TO THE GREATER OF:

  1. THE AMOUNT OF FEES YOU PAID TO CASHIRA FOR USE OF THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED U.S. DOLLARS (USD $100)

FOR FREE USERS OR USERS OF TRIAL VERSIONS, OUR TOTAL LIABILITY SHALL NOT EXCEED FIFTY U.S. DOLLARS (USD $50).

Exceptions and Non-Excludable Liabilities

The limitations and exclusions in this Section 16 do not apply to liability for the following:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Willful misconduct or gross negligence
  • Any other liability that cannot be excluded or limited under applicable law

Additionally, some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. The limitations in this Section 16 shall apply to the fullest extent permitted by law in your jurisdiction.

Basis of the Bargain

YOU ACKNOWLEDGE AND AGREE THAT CASHIRA HAS OFFERED ITS SERVICES, SET ITS PRICES, AND ENTERED INTO THESE TERMS IN RELIANCE UPON THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN, THAT THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND CASHIRA, AND THAT THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH HEREIN FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND CASHIRA.

Cashira would not be able to provide the Service to you on an economically reasonable basis without these limitations.
